1. Scope of Application
These Terms of Service apply to all contracts and usage agreements concluded between Aquaware and the users of the platform and the API.
2. Services & Availability
The platform provides environmental data, waterbody models, and an API. While we strive to ensure uninterrupted availability of the services, we cannot guarantee 100% uptime, especially during necessary maintenance work or third-party outages.
3. Limitation of Liability for Data
All analyses, forecasts, and environmental data are compiled and calculated to the best of our knowledge. Aquaware assumes no liability for the accuracy, timeliness, or completeness of the data. Decisions (e.g., agricultural planning or environmental protection measures) based on this data are made at the user's own risk.
4. API Usage & Rights
Automated usage of our systems via the API is only permitted for registered and authorized users. Excessive usage (exceeding rate limits), abuse, or automated extraction (scraping) of the web interface is strictly prohibited and can lead to the immediate suspension of the account.
5. User Accounts
Users are obliged to keep their access credentials confidential. If unauthorized use is suspected, we reserve the right to temporarily or permanently suspend access without prior notice.
